Coach Waiver & Acknowledgment
Effective Date: June 22, 2026
Required for all coaches. By registering as a coach on the Chaperone Performance platform, you acknowledge that you have read, understand, and agree to all terms of this Waiver and Acknowledgment.
This Coach Waiver & Acknowledgment ("Waiver") is entered into between you ("Coach") and Chaperone Performance. By registering as a coach on the platform, you agree to be bound by this Waiver, the Coach Qualifications & Code of Conduct Agreement, and the Terms of Service.
1. Independent Contractor Status
You acknowledge and agree that you are an independent contractor and not an employee, partner, joint venturer, or agent of Chaperone Performance. As an independent contractor, you:
- Are solely responsible for determining how and when you provide coaching services.
- Are responsible for paying all applicable federal, state, and local taxes on income earned through the platform.
- Are not entitled to employee benefits, workers' compensation, or unemployment insurance from Chaperone Performance.
- May not represent yourself as an employee or agent of Chaperone Performance to athletes, families, or third parties.
2. Assumption of Risk
You acknowledge that coaching and training activities involve inherent physical risks, including risk of personal injury, musculoskeletal strain, and exposure to environmental hazards. You voluntarily assume all risks associated with providing coaching services, including:
- Physical injury sustained while demonstrating or participating in athletic activities.
- Risks associated with working in varied environments (fields, gyms, pools, outdoor facilities).
- Exposure to communicable illnesses or injuries caused by athlete conduct during sessions.
- Risks associated with remote or online coaching, including technology failures.
3. Coach Responsibility
As a coach on the Chaperone Performance platform, you are solely responsible for:
- The content, quality, safety, and lawfulness of the coaching services you deliver.
- Ensuring that all training programs, drills, and activities are appropriate for the athlete's age, fitness level, and disclosed physical condition.
- Holding valid certifications, licenses, and credentials relevant to your coaching specialty and maintaining them in good standing.
- Carrying any required professional liability, general liability, or sports coaching insurance appropriate for your practice.
- Complying with all applicable local, state, and federal laws governing coaching, youth sports, and physical training.
4. No Medical Representation
You agree that you will not provide, offer, suggest, or imply medical advice, diagnoses, or treatment recommendations to athletes or their families. Coaching on the Chaperone Performance platform is limited to athletic training, skill development, and performance improvement. If an athlete presents with a medical concern, injury, or health symptom, you agree to:
- Immediately suspend the affected training activity.
- Advise the athlete or parent/guardian to consult a qualified medical professional.
- Document and report any serious health incident through the platform's reporting tools.
5. Release of Platform Liability
To the fullest extent permitted by applicable law, you hereby release, waive, and discharge Chaperone Performance, its officers, directors, employees, affiliates, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, losses, damages, or causes of action — whether known or unknown — arising out of or relating to your provision of coaching services through the platform, including:
- Personal injury or property damage sustained while coaching.
- Claims made by athletes or families related to your coaching services.
- Loss of income or business resulting from platform changes, suspensions, or termination of your account.
- Technical failures or interruptions to platform services.
This release does not apply to claims arising from gross negligence or intentional misconduct by Chaperone Performance.
6. Communication & Conduct
All communications with athletes and their families must occur exclusively through the Chaperone Performanceplatform's communication tools. You agree not to:
- Share personal contact information (personal phone number, email, social media) with athletes or families.
- Solicit or accept off-platform communication or sessions.
- Engage in any form of communication that is threatening, abusive, sexual in nature, or otherwise inappropriate.
- Initiate contact with minor athletes outside the platform's supervised communication environment.
7. Non-Circumvention Policy
You agree that for a period of 48 months from the date of your first interaction with any athlete or family introduced through theChaperone Performance platform, you will not directly solicit, accept, or retain coaching or training engagements with those athletes or families outside of the Chaperone Performance platform, without the express written consent of Chaperone Performance.
Violation of this provision may result in immediate account termination and may expose you to civil liability for damages, including all platform fees that would have been earned through the circumvented relationship.
8. International Use
Coaches accessing the Chaperone Performance platform from outside the United States acknowledge that they are responsible for compliance with all local laws and regulations governing the provision of coaching services, data privacy, tax obligations, and athlete protection in their jurisdiction. Chaperone Performancemakes no representation that the platform or its services are appropriate or available in all jurisdictions.
9. Background Check Consent
As a condition of joining the Chaperone Performance coaching network, you consent toChaperone Performance or its authorized third-party screening provider conducting:
- A criminal background check.
- A sex offender registry search.
- Identity and credential verification.
- Any other screening deemed appropriate to protect athlete safety.
You agree to provide truthful and accurate information for screening purposes and to immediately notify Chaperone Performance of any change in your background that would affect your eligibility as a coach on the platform.Chaperone Performance reserves the right to deny or revoke access to the platform based on background check results.
10. Confidentiality & Non-Disclosure
You acknowledge that through your use of the Chaperone Performance platform, you may have access to confidential information about athletes, families, platform operations, proprietary technology, and business practices. You agree to:
- Keep all such information strictly confidential during and after your use of the platform.
- Not disclose athlete or family personal information to any third party without explicit consent.
- Not use confidential platform information for personal gain or to benefit any competitor of Chaperone Performance.
- Not reproduce, publish, or distribute any proprietary platform content or methodology.
This confidentiality obligation survives the termination of your relationship with Chaperone Performance and the deactivation of your account.
11. Content & Media Release
You grant Chaperone Performance the non-exclusive, royalty-free right to use your name, likeness, professional bio, credentials, photos, videos, and coaching content submitted to the platform for the purpose of:
- Displaying your coach profile to athletes and families on the platform.
- Promoting the Chaperone Performance coaching marketplace in marketing and advertising materials.
- Showcasing coaching expertise and success stories.
You represent that you own or have the rights to all content you submit to the platform, and that such content does not infringe on any third-party rights.
12. Platform Enforcement Rights
Chaperone Performance reserves the right to:
- Suspend or permanently remove any coach from the platform for violation of this Waiver, the Code of Conduct, or the Terms of Service.
- Investigate complaints from athletes, families, or third parties regarding coach conduct.
- Place a coach on temporary hold during investigation of a complaint.
- Report concerning conduct to relevant authorities, including law enforcement, where required by law or warranted by the circumstances.
- Modify platform fee structures, policies, or features with reasonable notice.
13. No Guarantee of Income
Chaperone Performance makes no representations or guarantees regarding the number of athletes who will book sessions with any individual coach, the level of income a coach may earn through the platform, or the continued availability of the platform or its features. Coaching income on the platform depends on many factors outside Chaperone Performance's control, including market demand, coach profile completeness, and session reviews. You acknowledge that the platform does not guarantee any minimum income or booking volume.
14. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes arising from or related to this Waiver shall first be submitted to good-faith negotiation for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in Broward County, Florida.
15. Acknowledgment
BY REGISTERING AS A COACH ON THE CHAPERONE PERFORMANCE PLATFORM, YOU CONFIRM THAT YOU:
- Have read and understood this entire Coach Waiver & Acknowledgment.
- Agree to operate as an independent contractor and not as an employee of Chaperone Performance.
- Voluntarily assume all risks associated with providing coaching services.
- Agree to maintain the confidentiality of athlete and platform information.
- Acknowledge that this Waiver is legally binding and limits your legal rights against Chaperone Performance.
